We have filed a class action lawsuit against Sutter Health and its affiliates on behalf of Sutter employees who went through the Sutter disability accommodation process.  The Complaint alleges that Sutter maintained two unlawful policies regarding disability accommodation: First, when employees participated in the alternative job search process (seeking a transfer to an alternate, available position if they can no longer perform their current position), Sutter impermissibly limits the facilities to which disabled employees can transfer as a reasonable accommodation. Plaintiffs allege that Sutter does not permit as a reasonable accommodation a transfer to all Sutter facilities, which Plaintiffs allege violates California law.  Second, the Complaint alleges that Sutter Health places or keeps employees on unpaid leave until a doctor certifies that the employee has “permanent” work restrictions.  The lawsuit seeks to challenge this practice of placing or keeping disabled employees on leave when they could have been accommodated.
